UPR38: Denmark recommends Mozambique to enact legislation to explicitly prohibit discrimination on the basis of SOGI, and to review and amend its Penal Code to remove barriers for rural women and girls to access abortion.

Denmark welcomes the delegation of Mozambique and commends it for recently prohibiting child, early and forced marriage. However, laws on countering discrimination based on sexual orientation and gender identity is yet to be adopted. 

Denmark recommends the Government to enact legislation to explicitly prohibit discrimination on the basis of sexual orientation and gender identity.

We commend Mozambique on aligning the Penal Code with the Abortion Law in 2019, which ensured its increased implementation. However, we note with concern that access to abortion is de facto limited for rural women. 

Denmark recommends the Government to review and amend article 169 (1) a of the Penal Code to remove barriers for rural women and girls to access abortion.
